By accessing or using the CarryKo platform (website and mobile application), operated by CarryKo ("Company", "we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree, please do not use our services.
2. Description of Service
CarryKo is a technology platform that connects customers who need goods transported with verified vehicle owners and drivers ("Partners") across Kerala and India. We act as an intermediary and do not own or operate any transport vehicles ourselves.
3. Eligibility
You must be at least 18 years of age and capable of entering into a binding legal agreement to use our platform. By using CarryKo, you represent that you meet these eligibility requirements.
4. User Accounts
- You are responsible for maintaining the confidentiality of your login credentials.
- You agree to provide accurate, current, and complete information during registration.
- You are responsible for all activity that occurs under your account.
- We reserve the right to suspend or terminate accounts that violate these terms.
5. Bookings & Payments
- Prices displayed are estimates and may vary based on actual distance, route conditions, and goods weight.
- Advance payments are required to confirm a booking. The remaining balance is payable upon trip completion.
- All payments are processed securely through Razorpay. CarryKo does not store your payment card details.
- Cancellation charges may apply as per our cancellation policy displayed at the time of booking.
6. Partner Obligations
Vehicle owners and drivers ("Partners") who register on CarryKo agree to:
- Provide accurate vehicle and licence documentation.
- Maintain valid insurance, fitness certificates, and permits for their vehicles.
- Honour accepted bookings and maintain professional conduct during trips.
- Comply with all applicable traffic laws and transport regulations in Kerala / India.
7. Limitation of Liability
CarryKo acts as an intermediary technology platform. We are not liable for:
- Damage to goods during transit (unless covered by trip insurance).
- Delays caused by traffic, weather, road conditions, or force majeure events.
- Actions or negligence of individual drivers or vehicle owners.
Our total liability in any case shall not exceed the booking amount paid for the specific trip in question.
8. Intellectual Property
All content on the CarryKo platform — including logos, text, graphics, software, and design — is owned by CarryKo and protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our written consent.
9. Prohibited Conduct
You agree not to:
- Use the platform for any unlawful purpose or to transport prohibited goods.
- Attempt to gain unauthorized access to our systems or other users' accounts.
- Interfere with or disrupt the platform's operation.
- Provide false information or impersonate another person.
10. Dispute Resolution
In case of any disputes arising out of or relating to these terms or our services, the parties agree to first attempt resolution through our internal complaints process (accessible at /complaints). If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts in Ernakulam, Kerala, India.
11. Modifications
We reserve the right to update these Terms of Service at any time. Material changes will be communicated via email or a notice on our platform. Continued use of CarryKo after such changes constitutes your acceptance of the updated terms.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles.
